Baseball Rules

Overview: All WVU 50/50 Baseball Season Raffle (“Raffle”) tickets, transactions, participants, purchasers and winners are subject to these Official Rules, and to all applicable statutes, rules and regulations, including but not limited to the West Virginia Online Charitable Raffles statutes, the rules and regulations adopted pursuant thereto, and all other applicable rules and regulations adopted by any regulatory and/or enforcement agency having jurisdiction with respect to the activities to which these Official Rules apply.

Ticket Purchase: Raffle will be conducted at select home games at Kendrick Family Ballpark and online at WVUsports.com/5050. Raffle tickets will be sold starting Monday, March 16 at 9:00 a.m. and ending during the TCU game scheduled for Saturday, May 16, at the conclusion of the 8th inning. The winning ticket number will be drawn and announced during the 9th inning of the May 16th game. If that scheduled game is postponed, the raffle will conclude and be announced during the make-up game and during the innings mentioned above or, if the game is cancelled, shortly after the decision cancelling the game is made.

Raffle tickets can be purchased digitally at WVUSports.com/5050 or from a Raffle seller roaming throughout the venue during any of the select home games, which will be at WVU Athletics’ sole discretion.

Standard Ticket Prices: Tickets may be purchased with credit or debit as follows:

· 5 tickets for $10

· 20 tickets for $20

· 100 tickets for $50

· 250 tickets for $100

WVU Athletics reserves the right to sell tickets at a reduced promotional rate at its discretion, which amounts may vary from the standard ticket prices listed above.

Each receipt given to the entrant contains ticket number(s) equal to the number of chances or entries purchased for that game’s Raffle. Entries are not eligible for any past or future Raffle drawings. WVU Athletics is not responsible for printing errors in any Raffle-related material or any misdirected, incomplete, lost, late or illegible tickets or other errors or problems that may limit the entrant’s ability to participate in or win any Raffle. False or deceptive entries or acts will render the purchaser ineligible. Entrants may purchase as many tickets as they wish. No refunds will be made, except as otherwise determined by WVU Athletics in its sole discretion. Raffle ticket purchases are not tax deductible. Prices on tickets can vary at the discretion of WVU Athletics.

Eligibility: Raffles are open to legal residents of the 50 United States or District of Columbia who are eighteen (18) years or older at the time of entry and are physically located in the state of West Virginia when purchasing the raffle tickets. By purchasing a Raffle ticket, the entrant agrees to abide by all terms and conditions of these Official Rules and all federal, state, local and municipal laws and regulations applicable thereto. Some restrictions apply. Void where prohibited or restricted by law.

Raffle staff members are not eligible to purchase Raffle tickets at WVU home games at which they are working on, or on behalf of, the Raffle.

Random Drawing: Every transaction is electronically tallied. The running total may be periodically displayed and updated in real time on the scoreboard and various locations throughout the venue. The winning ticket number is selected by random drawing through an automated computer program upon conclusion of the Raffle at the end of the 8th inning. Winners need not be present to claim their prize. One (1) winner will be chosen out of the pool of purchased tickets. The decisions of WVU Athletics are final and binding on all matters relating to any Raffle.

Winner Notification: The winning ticket number will be posted on the scoreboard and announced during the 9th inning of the May 16th game versus TCU. The number will also be posted on wvusports.com/5050 within three (3) business days of the game date.

Prize: Each prize is cash and the amount depends on the amount of Raffle tickets sold. Reasonable, necessary, and actual expenses incurred in connection with the Raffle will be deducted from the total amount collected by WVU Athletics on that Raffle (“Expenses”). Each Raffle winner will receive one half (1/2) of the total amount collected by WVU Athletics on that Raffle less any Expenses. Each winning prize shall be paid to each Raffle winner via direct deposit or other method determined by WVU Athletics and as allowed by applicable law within two (2) weeks of WVU’s receipt of the Required Documentation defined below.

To claim your winning prize, potential winners should contact info@goldandblueenterprises.com. The purchased Raffle ticket is the only valid receipt for claiming a prize and must be redeemed via mail. To receive payment, the potential Raffle winner is required to submit a copy of their valid government-issued identification, their social security number, a copy of the original prize ticket, and a complete and executed Release of Prize Claim Form (“Required Documentation”).

Failure to submit any Required Documentation to WVU Athletics within the specified time period, noncompliance with these Official Rules, or return of any prize or prize notification as undeliverable, may result in disqualification and the prize being forfeited and donated to WVU Athletics. Potential winners may also choose to waive their right to receive the prize, at which time the prize will be forfeited and donated to WVU Athletics.

The Raffles are governed by West Virginia law. All winners will be subject to the IRS rules and regulations. For the season, WVU Athletics and/or an affiliated entity will complete and file IRS form W-2G and withhold federal income tax from the winner’s proceeds in accordance with IRS guidelines and regulations.

All Raffle winners will have thirty (30) days following the conclusion of the regular season to claim their prize. If a prize remains unclaimed after thirty (30) days following the conclusion of the regular season, the unclaimed prize will be forfeited and donated to WVU Athletics.

Each Raffle winner assumes all responsibility for any federal, state, county or local taxes, fees or withholdings. Each winner is advised to consult with their own tax advisor(s) with respect to the liabilities that may arise from winning a prize in the Raffle. No substitute prizes are permitted.

WVU Athletics is not responsible for any lost or stolen Raffle tickets.

ADDITIONAL CONDITIONS: By purchasing a Raffle ticket, purchasers agree to release and hold harmless West Virginia University; Gold & Blue Inc.; Bump Worldwide, Inc., each of their respective affiliates, and each of their respective board members, shareholders, partners, members, directors, officers, employees, agents, representatives, successors and assigns (collectively, the “Released Parties”) against any and all claims, demands, causes of action, damages, liabilities, losses, costs and expenses arising out of or relating to, directly or indirectly, such purchaser’s participation in the Raffle (including receipt and/or of any prize).

WVU Athletics, in its sole discretion, reserves the right to disqualify any person tampering with the entry process or otherwise violating these Official Rules. WVU Athletics further reserves the right to cancel, terminate or modify any Raffle for any reason, including, but not limited to, if any Raffle is not capable of completion as planned, including, but not limited to, infection by tampering, unauthorized intervention or technical failures of any sort, fraud or acts of God. WVU Athletics shall not be responsible for typographical, printing or other inadvertent errors in these Official Rules or in other materials relating to any Raffle. The Released Parties make no representation, warranty or guaranty of any kind concerning any prize and disclaim any implied warranty. Failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. All disputes will be resolved by courts of competent jurisdiction located in West Virginia

Any attempt to deliberately damage or undermine the legitimate operation of any Raffle may be in violation of criminal and civil laws and will result in disqualification from participation in the Raffle. Should such an attempt be made, WVU Athletics reserves the right to seek remedies and damages (including attorneys’ fees) to the fullest extent of the law, including criminal prosecution.

An entrant’s sole and exclusive remedy for any claim against WVU Athletics arising out of or relating to the sale of Raffle tickets or the conduct of the Raffle shall be the return of the purchase price paid for their Raffle ticket(s). In no event shall the Released Parties be liable to any party for any special, indirect, incidental, consequential, exemplary or punitive damages, whether arising in contract, tort or otherwise, even if advised of the possibility of such damages.
